Global-e will be the seller on record for all contracts (made with you) for the purchase and sale of JD Williams products from the Website. Global-e will take your payment and be responsible for ensuring the approved carriers deliver your orders. OUR MAXIMUM LIABILITY
If the limitations set forth above are held inapplicable or unenforceable for any reason, then JD Williams™ maximum liability to you for any type of damages shall be limited to the greater of: (a) US $100.00 or the equivalent in your own countries currency; and (b) the dollar amount of purchases you made (in your chosen currency) through the website during the twelve months prior to the date the claim arose, or such larger amount as applicable law requires.

ACCEPTANCE OF YOUR ORDER
Please note that completion of the online checkout process does not constitute our acceptance of your offer to purchase products or services from us. We will notify you by email as soon as possible to acknowledge that we have received and are processing your order. Our acceptance of your order will take place only when we take payment from you and despatch the product(s) or on commencement of the services that you ordered from us. The duration of our contract with you will start from when you receive the order despatch email and last until the last day of your right to return the products.

If the fulfilment of an order (or any aspect of it) would be illegal or unlawful, including by reason of breach of export controls or sanctions rules, JD Williams™ has the right to stop or cease to fulfil the order at any time, including after despatch of products and/or notification to you that the order has been received and is being processed. Where the supply of your product(s) or service(s) is delayed or prevented for reasons beyond our control (for example, material shortages, import delays or higher than anticipated demand) we will make every effort to keep you informed but shall be under no liability to you for such delay or failure.

Further, to the extent that any product offered on the Website is subject to an age requirement for purchase in the jurisdiction from which it is ordered or to which it is to be delivered, you may not purchase such product unless you are of the requisite age.

You warrant that you are authorised to use any credit cards, PayPal account, debit card or other payment options you are using to pay for your order and you have sufficient funds. When you place an order you represent and agree that the goods you order are retail purchases and not for commercial resale.
If there are any changes to the personal information you supply, including, but not limited to, your name or address, it is your responsibility to let Global-e know as soon as possible to avoid misdirected orders.
We do not authorise the purchase of our merchandise for resale purposes. To enforce this policy, we may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. We also reserve the right to cease doing business with those customers violating this policy. We do not authorise more than one promotional code (discount) per order, and we reserve the right to limit or prohibit orders that violate this policy.
The following Conditions apply for the redemption of any promotional codes we may offer to you:
(a) From time to time we may release promotional codes that may be used on the Site. Promotional codes can only be redeemed on the Site in accordance with the special terms and conditions stated on them.
(b) Promotional codes are valid for the specified period stated on them only. Certain products may be excluded from voucher promotions.
(c) Promotional codes are applied to orders as a whole. Accordingly, in circumstances where multiple products are purchased using a promotional code, and one or more products are returned, the discount is applied on a pro rata basis to each product for the purpose of establishing refund values.
DELIVERY (INCLUDING DELIVERY CHARGES AND TIMESCALES)
Delivery charges and timescales vary depending on the type of products ordered, the service you select and the delivery address. You’ll find full details of delivery charges at JD Williams.com. Please note that certain products and services may be subject to alternative delivery charges, restrictions and/or timescales. In particular:
- Delivery will be to an international address;
- If delivery cannot be made to a customer due to the customer not being present at the address or at the time allotted by the carrier or if a customer refuses to accept the products, Global-e reserves the right to deduct the cost for returning products to the returns centre from the customer’s refund for the order.
All risk in the products you order (including risk of loss and/or damage to the products) shall pass to you when they are delivered to the delivery address specified in your order. Neither we nor Global-e shall be under any liability for any delay or failure to deliver products if the delay or failure is wholly or partly caused by circumstances beyond our control.
Two choices of delivery service are offered for your purchase sent via Global-e. For full details of delivery costs and options, please see the Delivery section of the website.
It takes approximately 2 days for your order to be processed and dispatched from our warehouse.
The stated delivery period within which you will receive your order is approximate.
Goods will be sent to the shipping address you specify in your order and this cannot be changed once your order is processed.
DELIVERY TO A DIFFERENT ADDRESS
You may send your order to a different address other than your billing address if you wish. If you want to take advantage of this facility, simply click “Add new address” on the checkout page and follow the instructions given. Please note you can only send items from a single order to one address, whether it is the billing address or an alternate. Multi address delivery for single orders is not available.
If you haven’t received an item that appears on your packing slip(s), please inquire about it as soon as possible via service@Global-e.com . The assumption is that all the items have been successfully delivered unless we hear from you within thirty (30) days of the original order date.
If for any reason you want to send back something you’ve bought, you can make use of our simple returns service; In order to return products, please access the Returns Portal via https://web.global-e.com/Returns/portal within 30 days from the date the order was placed and ship the return products promptly. Simply return it in “as new” undamaged condition (with all tags attached) within 30-days of receipt. Global-e will not accept any return product that was used or damaged by you or where the original packaging of such product has been opened.
Upon receipt of the returned product, and confirmation that it has been returned in accordance with the applicable requirements, Global-e will reimburse you for the actual paid price of the returned product. The Returns Policy applies to all customers. This policy does not apply to faulty products.
It is in addition to, and does not affect, the separate legal right of cancellation which is available only to EU Consumers in some circumstances as explained below.
If you have paid any import related charges (Import Charges) in connection with your order (either pre-paid at checkout or paid upon receipt of the order directly to the applicable authority), you acknowledge that (a) you must seek reimbursement directly from the applicable authority in your country, (b) it will be your sole responsibility to claim such Import Charges back from the applicable authority in your country, and (c) Global-e cannot guarantee that such claim will be successful. If you have pre-paid Import Charges through at Checkout, upon your written request reasonable efforts will be made to assist you in obtaining reimbursement of such Import Charges.
Any Delivery Costs paid in connection with the Order are non-reimbursable or refundable. Moreover, any delivery and clearance costs incurred by you when returning Merchandise are non-reimbursable or refundable. Return deliveries are at your risk and we therefore advise you to use a courier service offering a tracking number, and to take out adequate insurance to cover the cost of the goods in transit.
RETURNS POLICY FOR FAULTY MERCHANDISE
If any product you order is damaged or faulty when delivered to you or has developed a fault, you may have one or more legal remedies available to you, depending on when you inform of the problem, in accordance with your legal rights. If you believe product was delivered damaged or faulty or has developed a fault, you should inform us as soon as possible, preferably with photographic evidence via service@Global-e.com, giving your name, address and order reference. Nothing in this section affects your legal rights.
OUR GOODWILL POLICY
Our “goodwill” refund policy is offered when goods are returned with a valid parcel summary document within 30 days of receipt. Our goodwill policy applies where there is no statutory right to a refund or exchange under the Regulations or otherwise. For a refund or exchange under our goodwill policy, items must be unused, returned in the original packaging and in a re-saleable condition.
EXCLUSIONS FROM THE GOODWILL POLICY
The following items are excluded from our “goodwill” returns policy:
Earrings, underwear with the hygiene seal removed, swimwear with the hygiene seal removed. These products can only be returned in accordance with your statutory rights (for example, if they are not fit for purpose or not as described).
Some of these items may have their own terms and conditions which will be provided to you at the time of purchase.
PRODUCTS LOST OR DAMAGED IN TRANSIT
If you choose to return any products to us, we will not be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, we reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.
DAMAGED OR INCORRECTLY SUPPLIED PRODUCTS
You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the delivery documentation or if you are unable to view the items on receipt, you must inform us (by email only) within a reasonable period of time. You must return the products to us as soon as possible after informing us that the products are damaged or have been incorrectly supplied. We may offer you a replacement product and any refunds given by us will be made to the same method by which payment was made when you placed your order and will be subject to our right to withhold amounts for products which are damaged on return.
YOUR STATUTORY RIGHTS
In addition to our goodwill policy, you also have statutory rights. In addition to the cancellation rights noted above, these include that the goods you purchase are of satisfactory quality, fit for purpose and as described. Within 30 days of the delivery, you may exercise the right to a refund if the product purchased is not of satisfactory quality, fit for purpose or as described. After the 30 day period, but within six months of the date of delivery and where the product is faulty, you are entitled to a repair or replacement or where that is not possible, or the repair/ replacement does not resolve the fault, a refund. After six months of the date of delivery, similar rights exist, but only if you can prove that the fault was present at the point of delivery.

We will do what we can to accommodate your request, but please note that order fulfilment systems are designed to get orders on their way quickly and efficiently. Therefore, we cannot change or cancel an order once it has entered the fulfilment process.
If your cancellation or change request is received after the goods have entered the fulfilment process, they will be shipped and charged.
Please note: If you cancel an item that qualified you for a promotion or special discount, you may no longer receive that discount or promotion.
YOUR RIGHT TO CANCEL (E.U. COUNTRIES ONLY)
If you are contracting as an EU consumer online, you have the right to cancel (under the Consumer Rights Directive 2011/83 as implemented in the applicable EU member state (“CRD”)), all or part of your contract at any time up to 14 calendar days after the day on which you receive the goods you ordered. Any paid delivery charge will be included in your refund once all (not part) of your order which you wish to return has been received. Please note the delivery charge refund will be to the value of standard delivery. Global-e will process your refund with 14 days of receipt of the products, to the specified address. You must take reasonable care of the goods while in your possession and they must be returned (undamaged) before a refund can be issued. If you wish to cancel (or are considering cancelling) a product you have ordered, please be aware of the following terms that apply:
Applicability of cancellation rights: Legal rights of cancellation under the CRD available for UK or EU consumers do not apply to certain products (for example, some lingerie (for hygiene reasons) and any products with a hygiene seal where the seal is broken).
Damaged or incorrectly supplied products: You should check all products you receive against your order. If the products you receive are damaged or incorrectly supplied on delivery then you must note the details of any damage or error in supply on the delivery documentation or if you are unable to view the items on receipt, you must inform us (by email only – service@Global-e.com) within a reasonable period of time. You must return the products as soon as possible after informing us that the products are damaged or have been incorrectly supplied.
Damage during the course of returning products: If you choose to return any products, neither we nor Global-e will be responsible for any loss or damage to them in transit and, for this reason, we recommend that you use a recorded delivery service. If returned products are lost or damaged in transit, Global-e reserve the right to charge you (or not to refund any amounts attributable to) such loss or damage.
Other cancelled products: If you want to cancel products that are not damaged or incorrectly supplied, then you must inform us of this within 14 calendar days the day after you receive the goods in accordance with the CRD or otherwise as soon as possible. You must take reasonable care of the products that you wish to cancel. Products should be returned undamaged, as new, in or with their original packaging (with all tags attached).
You will need to send back the goods or hand them over (undamaged with all tags attached) at: Global-e c/o Norsk, Building 436, Argosy Road, East Midlands Airport, Derby, UK DE74 2SA unless a different address is provided to you, without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation of the contract. The deadline is met if you send back the goods before the period of 14 days has expired.
Please note that you will bear the direct cost of returning the goods.

ACCEPTED PAYMENT METHODS
You may pay by debit card, credit card or another alternative payment method specified as part of the checkout process. Global-e may change the payment methods at any time but this will not affect any existing order. The availability of a certain payment method may depend on your geographical location.
You may pay with the payment methods specified at Checkout. The availability of such payment methods is dependent on your geographical location. When being charged, the descriptor you will see shall include Global-e identified as ‘Global-e’ and will look like this or something similar: **Global-e//JD Williams**.
If you place an order on our Website, you acknowledge and agree that: (i) Global-e, or one of their third party payment processors (“Payment Processor”), will charge you through the payment method you have selected at checkout for such order and such other amounts payable under these Terms and Conditions that may be due in connection with the order; (ii) you will provide valid and current information about yourself; (iii) Global-e may use the tools, software or services of Payment Processors to process transactions on our behalf; and (iv) you may be charged bank or credit/debit card issuer with additional fees (such as foreign transaction fee or cross border fee) or surcharges imposed by your bank or credit/debit card issuer, and those are not Global-e or JD Williams™ charges or fees, and neither have control over this nor have any way to mitigate this, as this is purely up to the relationship and commercial terms between you and your bank or credit/debit card issuer, and Global-e (or JD Williams™) also have no way of knowing in advance whether you will be charged such fees or surcharges, as each bank and credit/debit card issuer has its own policy, and our commitment is to acquire the amount set at Checkout in your local currency.
The price of products is calculated according to the rate of exchange between the base currency on the Website and the local currency of the destination country at the time you place your order. Global-e reserve the right to update such exchange rates regularly, and you acknowledge that such updates may affect product pricing on the Website. You will be charged according to the applicable exchange rate at the time you place your order via the Website.
For certain shipping destination countries and/or products, you may be offered the option to pre-pay applicable taxes, which will then be calculated and included in the final price when you place an order through the Website. You acknowledge that such taxes are set by the shipping destination country and therefore may vary from country to country.
For clarity, the option to pre-pay taxes may not be available for your shipping destination country and/or your products, in which case: (a) you acknowledge that the amount of taxes displayed under the pre-pay option on the Website is an estimate only, and the actual taxes payable by you may be more or less than such estimate; and (b) you will be fully responsible for paying all applicable taxes directly to the relevant authority (and for reclaiming them in the event of a cancellation of your order or the return of products, to the extent permitted in the these Terms and Conditions) as determined by the authorities of the shipping destination country, and neither Global-e nor JD Williams™ shall have any responsibility or liability in connection with the foregoing.
Global-e may contract with a local licensed customs broker in your country, in which case, by placing an order through the Website, you authorise the applicable customs broker to act as your agent to: (a) conduct transactions with the local customs authority, (b) execute related documents on your behalf in connection with the import of products in your order, (c) facilitate your payment of applicable taxes; and (d) if applicable, return such products to JD Williams™ (subject to these Terms and Conditions) and (if applicable) handle the associated reimbursement claim for taxes paid. You acknowledge that, in the case of a return of products under the Terms and Conditions below, if Global-e are able to obtain on your behalf reimbursement of taxes paid on orders, any such reimbursement will be paid by the applicable tax authority to the customs broker, and then Global-e will reimburse such amounts directly to you if and to the extent, and only after, such amounts were received from the customs broker.
Global-e reserve the right to terminate the agreement with you and suspend or terminate your access to order from the Website without notice to you:
- if there are grounds for suspecting you committed or are about to commit, or are connected to, fraudulent or illegal activity or
- if you have failed to make valid and due payment or if you breach any of these Terms and Conditions.
If you breach these Terms and Conditions, or a liability is incurred or arising from your orders, you will be responsible for the costs and expenses that we/Global-e or the respective officers, directors, or employees incur as a result of the breach, including our reasonable legal costs.
When placing an order, you agree that all the information you provide is accurate and complete including your contact details and address. You warrant that you will not use an invalid credit card or false name to order from the Website. All orders are subject to and conditional upon acceptance.

No delay by us or Global-e in exercising any right or remedy under these Terms and Conditions shall operate as waiver of that right or remedy or affect our or Global-e exercising that right or remedy.
If any of these Terms and Conditions are found to be illegal, invalid or unenforceable by any court of competent jurisdiction, the rest of these Terms and Conditions shall remain in full force and effect.
No third party shall be entitled to enforce any of these Terms and Conditions.

Profiling is a term used to describe a form of data processing where significant volumes of data made up of lots of different data types – such as browser history from Cookies, age, gender, size, transaction history, demographics and buying habits – are all used in an aggregated, anonymised and non-personalised form to evaluate and predict, based on statistical analysis, what you may or may not want to purchase from us by assigning you to a profile type. INTEREST BASED ADVERTISING
When you register to open a personal account, we will hold your personal data which you have provided to us which includes:
- your name, age/date of birth and gender;
- your contact details: postal address including billing and delivery addresses, telephone numbers (including mobile numbers) and e-mail address;
- purchases and orders made by you;
- your on-line browsing activities on the JD Williams website;
- your password(s);
- your communication and marketing preferences;
- your interests, preferences, feedback and survey responses;

- your correspondence and communications with JD Williams; and
- other publicly available personal data, including any which you have shared via a public platform (such as a Twitter feed or public Facebook page).
When you make a subsequent card payment to purchase products from us, we will use your personal data and card information to process the order. Global-E, our payment provider, will take your card payment and send your personal data to their card payment and banking providers to ensure that you have sufficient funds to cover the value of the transaction. Without this data, we are unable to fulfil your order.
We will hold your personal data for 6 years, plus the current financial year, after the date of your last transaction on your personal account.
PROCESSING CARD PAYMENTS
We will use your personal data to administer and to operate your personal account as set out below. We will collect and use the contact details that you provide to us to communicate with you about your account and in relation to the products and services we provide to you.

DELIVERING YOUR GOODS – SHARING YOUR DATA
We will use your personal contact details such as name, postal address, phone number and email address that you provide to us in respect of delivering products or services to you. We will share this information with our suppliers who directly despatch orders to you or our delivery partners who may contact you to arrange a convenient delivery time and provide you with updates as to when they will arrive.
PROCESSING RETURNS AND REFUNDS
We use your customer account and contact details to verify any returns and refunds that we process. Global-E process all payments in line with their obligations under the PCI-DSS regulations and will encrypt the payment details before sending to their payment and banking provider.
ENQUIRIES AND COMPLAINTS
If you have any complaints with regards to the operation of your personal account, please contact us via emailing firstname.lastname@example.org so we can deal with your complaint as quickly as possible. We will need to access your personal data and account history to verify your identity for security reasons and deal with the details of your complaint. Details of any complaints received will be logged and recorded so they can be dealt with accordingly.
GENERAL SERVICE COMMUNICATIONS
We will use your personal data for all general service communications including processing orders, notifying you of orders received, updating you on deliveries, despatched or products out of stock. We need to do this for the performance of the contract and terms and conditions that you have signed.
As a valued customer, we may use your personal data to contact you by email to ask you to participate in one of our service improvement programmes. We will share your personal contact details with our chosen third party partners and service providers who may carry out these service improvement programmes on our behalf. We will always make you aware of how we will use the information that we gather from you at the time of contacting you for any specific service improvement programme. We have a legitimate business interest in contacting our customers in this way and will always treat your involvement in any service improvement programme, and associated personal data, in confidence.
Should you not wish to participate in our service improvement programme, you can simply decline to participate at the point of contact or, should you wish never to be contacted for the purpose of market research, you can tell us at any time by emailing email@example.com.
From time to time, we will contact you to take part in a customer satisfaction survey. We often use third party partners to collect this information on our behalf. We will share your basic personal data – name, address, phone number and email – for them to contact you to ask if you wish to participate in such surveys. We, or our third party partners, may sometimes follow up on surveys with you to get more information from you regarding specific complaints or feedback. RESEARCH & FOCUS GROUPS
From time to time, we employ different market research agencies, who act on our behalf, to contact our customers with the aim of getting a more detailed understanding of what our customers think about our products and services. We will share your basic personal data – name, address, phone number and email – for them to contact you to ask if you wish to participate in our service improvement programme. We may also share more personal data about your shopping habits, including the size and type of products that you have purchased if this is relevant to the market research. Occasionally, we ask our research companies not to tell customers that they are contacting you on our behalf, for example for brand research purposes, as we do not want to influence your answers. However, the market research company is obliged to disclose this information should you ask at the end of the survey. We actively use social media platforms as a way of connecting, and getting closer, to our customers to hear and understand what our customers think about us and our products and services. Occasionally, we may contact you directly via those social media platforms if we would like to share your comments or pictures with other customers or publish them in our marketing materials. We will always ask you if you are happy for us to use your data in this way and will keep any data that you provide to us, such as email address, confidential and secure.
In the event that you need to make a claim against us, whether that be a product issue or personal injury claim, we will use your personal data and any supporting evidence that you provide to us to process your claim, including sharing this with our chosen insurance companies. From time to time where a claim is outside of our insurance policy, we may also need to engage with external lawyers and share your personal data with them.
As part of delivering our products and services to you, we will share your personal data with carefully chosen Third Party Processors and Partners who carry out a number of services on our behalf. Should you wish to obtain a list of our latest Third Party Processors and Partners, you can request this at any time by contacting our Data Governance team.
Any third party that communicates with you on our behalf must only do so for the purpose of carrying out the services and not for the purpose of direct marketing their own products and services. If you have any concerns about any of our third party processors and partners, please contact our Data Governance team.
Aside from our service providers, JD Williams™ will not disclose your personal data to any third party, except as set out below. We will never sell or rent our customer data to other organisations for marketing purposes.
We may share your data with:
- governmental bodies, regulators, law enforcement agencies, courts/tribunals and insurers where we are required to do so: –
- to comply with our legal obligations;
- to exercise our legal rights (for example in court cases);
- for the prevention, detection, investigation of crime or prosecution of offenders; and
- for the protection of our employees and customers.
We will only allow our service providers to handle your data when we have ensured that they have, and operate, appropriate data protection and security controls. We will always ensure we have in place contractual obligations on service providers including some relating to data protection and security. This helps to ensure that they can only use your data to provide their services to yourselves and us but for no other purposes.
To deliver products and services to you, it is sometimes necessary for JD Williams™ and Global-E to share your data outside of the European Economic Area. This will typically occur when service providers are located outside the EEA or if you are based outside the EEA. These transfers are subject to special rules under data protection laws.
